Terms of service

1. General Provisions 

1.1. The subject of these Regulations is to define the rules of sale and operation of the online store conducted at audiohygge.pl.
1.2. The owner of the online store registered at audiohygge.pl is Demure Sp. z o.o., ul. Hoża 86 lok. 410, 00-682 Warsaw, NIP: 7011247570.
1.3. The online store sells goods via the Internet, through the online store at www.audiohygge.pl.
1.4. Placing an order is only possible after accepting the Regulations.
1.5. The Regulations are part of the contract concluded between the Seller and the Client on the basis of art. 384 of the Civil Code.
1.6. The Buyer is understood as any natural person, legal person or organizational unit not having legal personality, who has the right to perform independent actions in accordance with legal provisions and has their own e-mail account.
1.7. A Consumer is understood as a natural person purchasing products in the Online Store on the basis of art. 221 of the Civil Code.
1.8. To entities other than Consumers, the provisions of the Act of May 30, 2014, on consumer rights do not apply. The Seller is not liable under warranty for physical and legal defects of the product in relation to persons or entities not being Consumers.
1.9. Information contained on the Seller's website constitutes an invitation to conclude a contract within the meaning of art. 71 of the Civil Code, but does not constitute a commercial offer within the meaning of art. 66 of the Civil Code.
1.10. The Seller on the store's website presents digital photos of products, making every effort to ensure that the photos are of the highest quality and best reflect the actual state and colors of the presented products.
1.11. Photos on the store's website are the intellectual property of the Seller within the meaning of the provisions of the Act of February 4, 1994, on copyright and related rights.
1.12. Prices in the Seller's Online Store are given in Polish Zlotys (PLN) and are gross prices, meaning they include all components, including due taxes.
1.13. The Seller reserves the right to change prices of products on the Seller's Online Store website, introduce new products, remove unavailable products, conduct and cancel promotions and introduce other changes.

2. Orders

2.1. Orders are accepted through the online system located at www.audiohygge.pl. When placing an order, it is necessary to correctly fill in the required fields according to the instructions.

2.2. It is possible to place an order for a product located on the Seller's Website with a non-standard size or color individually by sending an inquiry to the email address: hello@audiohygge.com.

2.3. The Seller reserves the right not to produce a product of a non-standard size if technical and structural conditions of the product do not allow it, and to change the price of a non-standard product if additional costs are associated with its production.

2.4. The conclusion of a distance sales contract between the Seller and the Buyer occurs at the moment of successful completion of the purchase process on the audiohygge.pl website.

2.5. The Seller undertakes to deliver to the Buyer a brand new product, free from technical and legal defects, and legally introduced into circulation.

2.6. The Consumer's obligations end at the moment of receiving the goods and paying the full price, in accordance with these Regulations, subject to the obligations incumbent on the Consumer in the event of a complaint or withdrawal from the contract.

2.7. In the event of unavailability of the ordered product, the Seller undertakes to inform the Buyer about this fact no later than 14 working days from the date of placing the order.

2.8. It is the Buyer's responsibility to decide on the method of fulfilling the remaining part of the order – partial fulfillment, cancellation of the entire order and refund, extension of waiting time for the order, exchange of the missing product.

2.9. Proof of purchase of goods is the email confirming the purchase of the product on the audiohygge.pl website, which the client receives at the email address provided by the Consumer during placing the order.

2.10. Payment for the order can be made through the following payment methods: *

  • Visa,
  • Visa Electron,
  • MasterCard,
  • MasterCard Electronic,
  • Maestro.

2.11. The entity providing online payment services is Przelewy24.

2.12. Delivery of goods takes place in the manner specified in the order. Shipments are delivered by a courier company chosen by the Seller. The shipment is dispatched no later than 14 working days from the date of crediting the payment to the Seller's bank account or in the case of choosing the "cash on delivery" payment option after the goods preparation process is completed.

2.13. The cost of international shipping is determined individually through the store system located on the audiohygge.pl website.

3. Complaints

3.1. The Seller bears responsibility if the sold item has a physical or legal defect (warranty).

3.2. The Seller is released from liability under warranty if the consumer was aware of the product's defect at the time of concluding the contract.

3.3. If the sold product has a defect, the Consumer may submit a specific statement about a price reduction or withdrawal from the contract, unless the Seller promptly replaces the defective product or removes the defect.

3.4. If the sold product has a defect, the Consumer has the right to demand the replacement of the item with a defect-free one.

3.5. The Consumer cannot withdraw from the contract if the defect is insignificant.

3.6. If only part of the products from the order has defects, the Consumer has the right to withdraw from the contract only in the case of defective items.

3.7. A Consumer filing a complaint should send to the email address: hello@audiohygge.com a complaint statement, proof of purchase of the product, and transfer details, and then send the purchased goods by parcel with the note COMPLAINT to the address: Kompanii AK Goplana 3/20, 02-495 Warsaw.

3.8. The complaint statement should contain: Product name, order number, complainant's details (name, surname, address, contact phone, email) along with a detailed description of the physical defects of the complained goods.

3.9. The Seller undertakes to reimburse the consumer for costs related to the return of defective goods, immediately after considering and accepting the Consumer's claims.

3.10. If it is not possible to repair or replace the purchased goods with new ones, the Seller will inform the Consumer about the possibility of exchanging the goods for another.

3.11. Upon receiving the shipment, the Consumer is obliged to check it in the presence of the delivery person and, if mechanical damage occurred during transport, to draw up a protocol signed by the Consumer and the delivery person.

3.12. Complaints are processed within 14 working days from the date of delivery of the product to the address indicated by the Seller.

3.13. The Consumer will be informed about the results of the complaint by the Seller via email.

3.14. If the complaint is resolved positively, and the Consumer does not use the option to exchange the product for a new one or another product, they will receive a refund of the order value to their bank account no later than 14 working days.

4. Personal Data Protection

4.1. The provision of personal data by the Buyer is voluntary; however, its absence makes it impossible to fulfill the placed order.

4.2. By making a purchase, the Buyer agrees to the collection, processing, and use of personal data by the Seller for the purpose and to the extent necessary for the Seller to fulfill the order.

4.3. The administrator of personal data is Demure Sp. z o.o., ul. Hoża 86 lok. 410, 00-682 Warsaw, NIP: 7011247570.

4.4. Data will be processed with all security requirements specified in the Act of August 29, 1997, on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended) and in the executive regulations issued thereunder.

4.5. The Buyer has the right to free access to their personal data, to correct it, and to demand cessation of its processing and its deletion from the database, which should be reported in writing to the Seller at the email address: hello@audiohygge.com.

4.6. The Buyer may, but is not obliged to, consent to receiving advertising and promotional materials via email correspondence.

5. Final Provisions

5.1. Any disputes between the Consumer and the Seller are primarily resolved amicably based on art. 1831 et seq. of the Code of Civil Procedure.

5.2. The law applicable to the assessment of the legal relationship shaped on the basis of these Regulations is Polish law.

5.3. In matters not regulated by these Regulations, the provisions of the Civil Code and other acts apply.
